These Terms of Service ("Terms") govern your access to and use of the website apipay.cash and the APIpay payment platform operated by APIpay LLC, a Florida limited liability company ("APIpay", "we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms.
APIpay provides a merchant payment platform that facilitates QR-code and ACH-based payments between merchants and their customers. APIpay is a technology provider and is not a bank. Funds transfers and settlement are performed through partner financial institutions.
You must be at least 18 years old and legally able to enter into contracts. Business accounts require accurate legal entity information, EIN, beneficial ownership disclosures, and banking credentials. You are responsible for maintaining the confidentiality of your account credentials.
APIpay charges 1% per successful transaction with no monthly fees, unless otherwise agreed in writing. Fees are disclosed in your merchant dashboard and may be updated with 30 days' notice.
You may not use the Service for unlawful activity, fraud, money laundering, sale of illegal goods, adult content, unlicensed gambling, unregistered securities, or any activity prohibited by our acceptable-use policy or by our payment processing partners.
By providing your phone number, you consent to receive account, transactional, 2FA, and customer-care SMS messages from APIpay LLC. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Full details in our Privacy Policy.
The Service is provided "as is" without warranties of any kind. APIpay does not guarantee uninterrupted service, successful settlement of any specific transaction, or absence of errors.
To the maximum extent permitted by law, APIpay LLC, its officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue, arising out of your use of the Service.
You agree to indemnify and hold harmless APIpay LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
